Memphis, TN – It's the 11th day of early voting in the November 2nd Election, and an investigation into the Shelby County Election Commission has wrapped. Shelby County District Attorney Bill Gibbons announced no criminal charges will be filed in connection to voting irregularities that took place during the last election August 5th. Gibbons said the D.A.'s Office found "no credible evidence" that the Shelby County Election Commission employee who loaded May poll-book data in August did so on purpose; or that the commission used the error to influence the outcome of the election.
Gibbons based his determination on an investigation into the Election Commission he requested be conducted by the Tennessee Bureau of Investigation (TBI).
In August some voters, including Gibbons, were told they had already voted when they hadn't.
Democrats sued the Election Commission saying the election was "incurably uncertain," but the case was dismissed.
Gibbons and Director of the TBI Mark Gwyn did unveil a Voter Trust Task Force Tuesday, October 19th--6 days into early voting. The task force is on hand to investigate any problems the Election Commission identifies as possibly criminal.
In a press release the D.A.'s Office said: "Voters in Shelby County who observe any potential problems at the polls during early voting or on November 2 should contact the Shelby County Election Commission at 901-545-4125."
The D.A.'s Office says so far they have not been notified by the Election Commission of any problems.
The Department of Justice has also appointed a District Election Officer to respond to complaints of fraud or abuse. Assistant U.S. Attorney Justin Bailey is on duty while polls are open. His number is (901) 969-2920.
